Art. 1 — Purpose
These General Terms and Conditions define the rights and contractual obligations between Atelier Marbella (the “Seller”) and its customers (the “Customer”), and govern all purchases made through ateliermarbella.com.
By placing an order, the Customer acknowledges having read and accepted these Terms without reservation. Atelier Marbella reserves the right to update these Terms at any time; the version in effect at the time of the order shall apply.
Art. 2 — Products
Atelier Marbella sells art prints inspired by Mediterranean life and aesthetics, available in the following formats: Matte Art Prints, Canvas Prints, and Framed Prints.
All products are made to order through our production partner Gelato, and printed on premium materials. Product descriptions and dimensions are available on each product page.
Products are subject to availability. In the unlikely event that an item cannot be fulfilled, the Customer will be notified promptly and offered a full refund or an alternative product.
Art. 3 — Prices
All prices are displayed in Euros (€), inclusive of applicable taxes, and exclusive of shipping costs. Shipping fees are calculated at checkout based on destination, size and weight.
Atelier Marbella reserves the right to modify prices at any time. The price applicable is the one in effect at the time the order is confirmed.
Art. 4 — Payment
Payments are processed securely via Stripe. Accepted methods include Visa, Mastercard, and other major credit and debit cards.
Title to the goods passes to the Customer only upon full receipt of payment.
Art. 5 — Orders
Upon placing an order, the Customer receives a confirmation email summarising the order details and reference number. This confirmation constitutes acceptance of these Terms.
Art. 6 — Delivery
Orders are shipped worldwide via our production partner Gelato, directly from the nearest production facility to your delivery address.
Estimated delivery times are provided for guidance only and do not constitute a firm commitment. Atelier Marbella shall not be liable for delays caused by the carrier, customs, or events outside our control.
Upon delivery, the Customer is responsible for inspecting the package. Any visible damage to the packaging must be noted with the carrier at the time of delivery.
Art. 7 — Returns & Refunds
All Atelier Marbella products are made to order. As each print is produced specifically upon receipt of your order, they are exempt from the standard 14-day withdrawal right under EU Consumer Rights Directive Article 16(c) (goods made to the consumer’s specifications or clearly personalised).
We do not accept returns or exchanges except in the following cases:
- Damaged in transit: If your order arrives damaged or defective, please contact us within 48 hours of delivery at hello@ateliermarbella.com with your order number and clear photographs of the damage. We will arrange a replacement at no additional cost.
- Wrong item received: If you receive an item different from what you ordered, contact us within 48 hours and we will rectify the error immediately.
Claims submitted after 48 hours of delivery may not be accepted. Products must not be altered, framed (if applicable), or further processed before a claim is made.
Art. 8 — Intellectual Property
All artwork, images, content, and brand elements on ateliermarbella.com are the exclusive intellectual property of Atelier Marbella. Any reproduction, distribution, or use of these elements — in whole or in part — without prior written consent is strictly prohibited.
The purchase of a print does not transfer any copyright or intellectual property rights to the Customer.
Art. 9 — Personal Data & Privacy
Personal data collected during the ordering process (name, address, email) is used solely for order processing and communication purposes. This data may be shared with our production and logistics partners (Gelato, shipping carriers) solely for order fulfilment.
We do not sell or share your personal data with third parties for marketing purposes. Customers may request access to, correction of, or deletion of their personal data at any time by contacting us at hello@ateliermarbella.com.
Art. 10 — Liability
Atelier Marbella’s liability is limited to the value of the order placed. We shall not be held liable for indirect damages, loss of use, or loss of data arising from the use of our website or the products purchased.
Force majeure events (natural disasters, strikes, supply chain disruptions, etc.) release Atelier Marbella from any contractual obligation without compensation.
Art. 11 — Governing Law
These Terms are governed by Spanish law. In the event of a dispute, the parties shall seek an amicable resolution. Failing that, the competent courts of Marbella, Spain shall have exclusive jurisdiction.
